Pemenuhan Hak Atas Pendidikan bagi Anak-anak Pengungsi di ASEAN dengan Memperkuat Prinsip ASEAN

Abstrak

Hak pendidikan bagi pengungsi, terutama bagi pengungsi anak, dianggap sebagai hak dasar. Menurut data UNHCR, hampir setengah dari pengungsi anak belum menerima pendidikan baik formal maupun informal. Pemenuhan hak atas pendidikan di kawasan ASEAN memiliki tantangan tersendiri, dalam hal ini, ASEAN Ways sering dianggap sebagai hambatan utama. Namun, ASEAN Ways telah terbukti untuk mempertahankan stabilitas di kawasan ASEAN. Penelitian ini menyatakan bahwa pendekatan ASEAN Ways dalam melindungi hak pendidikan memberikan fondasi yang lebih kuat bagi pemenuhan hak pendidikan bagi pengungsi anak di kawasan ASEAN. Dalam memenuhi hak atas pendidikan bagi pengungsi anak, seringkali hal ini dibatasi oleh kebijakan dan regulasi nasional yang berbeda antara satu negara dengan negara lainnya. Namun, dengan dukungan ASEAN sebagai organisasi regional melalui penguatan prinsip ASEAN Ways, hal ini akan mendorong pemenuhan hak pendidikan sambil mempertahankan stabilitas di kawasan ASEAN. Makalah ini akan membahas bagaimana pendekatan ASEAN Ways dalam memenuhi hak pendidikan berjalan dalam hal kebijakan dan pelaksanaannya melalui kesepakatan Bali Process dan melalui organisasi ASEAN yang relevan seperti ASEAN Intergovernmental Commission on Human Rights (AICHR) and ASEAN organizations in education cooperation (SEAMEO).
