Kehancuran Benda Cagar Budaya Saat Konflik Bersenjata: Eksistensi Blue Shield Emblem

ABSTRAK Penghancuran benda cagar budaya secara disengaja yang tidak digunakan untuk kepentingan militer menimbulkan kerugian terparah yang dialami umat manusia. Benda cagar budaya memiliki nilai besar sebagai warisan budaya umat manusia, sehingga penciptaan Blue Shield Emblem pada properti kebudayaan menjadi cara krusial bagi upaya perlindungannya melalui Konvensi Den Haag 1954 dan dua protokol tambahannya. Berdasarkan regulasi tersebut, Blue Shield Emblem ditempatkan pada benda cagar budaya baik untuk perlindungan umum, khusus, maupun perlindungan yang ditingkatkan. Tetapi pada prakteknya terjadi perbedaan interpretasi implementasi diantara negara-negara tentang penggunaan Blue Shield Emblem ini yang berkonsekuensi benda cagar budaya terkena serangan yang tidak perlu. Oleh karena itu, penelitian ini membahas permasalahan dasar yang krusial bahwa bagaimana ketentuan penggunaan Blue Shield Emblem yang sesuai dengan bentuk, fungsi, dan penempatannya, agar dapat terlihat jelas oleh para pihak yang bersengketa maupun bagi masyarakat sipil, sehingga dapat menjamin terhindarnya kehancuran yang tidak perlu pada benda cagar budaya. Penelitian ini berbentuk normatif dengan studi kepustakaan pada bidang hukum humaniter internasional sebagai alat pengumpul data. Penelitian ini mengindikasikan bahwa dibutuhkan ketentuan internasional yang padu perihal ukuran bentuk, penempatan, dan cara pemasangan Blue Shield Emblem pada benda cagar budaya.
